1. OWNERSHIP OF COPYRIGHT

5. ENFORCEMENT AND REMEDIES

Bryant Clark expressly reserves the right to pursue all legal remedies available, including but not limited to:

  • Injunctive relief

  • Statutory damages

  • Actual damages and profits

  • Attorneys’ fees and costs

  • DMCA takedown notices

  • Civil litigation in Texas courts

 

6. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

The Website complies with the Digital Millennium Copyright Act (17 U.S.C. § 512).

Any unauthorized distribution or reproduction of the Works may result in immediate takedown requests issued to hosting providers, platforms, or service providers.

 

7. GOVERNING LAW AND VENUE

This Notice and all matters arising from or related to the Works shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

Any legal action shall be brought exclusively in a court of competent jurisdiction located in the State of Texas, and the parties consent to personal jurisdiction therein.

 

8. NO WAIVER

Failure to enforce any provision of this Notice shall not constitute a waiver of any right or remedy.

 

9. SEVERABILITY

If any provision of this Notice is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
